    Hey Gurus,
    I am in confusion here.
    I applied for my I-485(EB2, PD= Dec,2006) in july 2007. I was married that time and my wife was in India. She didnt get delhi consulate appointment so i missed her while i applied for my I - 485. Now she is in US on H4 visa. I got RFE last month on my I 485 regarding employment verification. I have replied for RFE.

    My Question here is:-
    If I get my green card(that chances are very less because my PD are not current... but on safe side), How i can add her into GC or 485 stage.

    I am planning to go to Canada for H1B visa stamping. Will there be any problem if i have company on H1B. I opened in 2003 and My friend is working in that company. I am working for my employer only. Will there be any problem if i have company either in GC stage or getting Visa in Canada.

    thanks for the info. Since he got I 485 approved the GC status already began for him or only on receipt of GC his Green card status begins.
    Which is correct? Any help.

    Hi Old Monk and GC.....Thank you for your reply. I am canadian citizen by naturalization. Is it a fast process for naturalization (not by birth) Canadian Citizen too? I havn't applied for I-765. As right now, my husband has no intention me to work in USA. Suppose in future if I decide to work...Can I work once my GC will approve, or do I have to have file I-765 to get permission to work?

    Its been only one week, since I have mailed my I-485 to Chicago office. I havn't got my reciept yet. So,will wait for another week or so. As someone said on this forum usually it takes 10 days to get the receipt. My question is once I get my receipt can I apply for Social Security and Driving Licence? Can I leave the country to visit my family back home too? Or do I have to wait untill I get my Permanent residence card? As per GC or lets hope for canadian citizen it takes 6-9 months to approve their case. TIA.

    Sent applications to NSC on 6/29 but receipted by CSC on 8/28. Later it was transfered to NSC back. No FP notice yet. But 2 LUDs on I-485, 9/19 and 9/20. EAD and AP are approved from CSC.

    i was on h4 , then i applied for new h1 and new ead( through from primary person ) at a time.

    i got h1 and ead approvals. i cancelled my h1 because i got ead approval though primary person.

    so right now primary person and me both are used our eads. i am doing job using ead .

    what my question is if i dont want to continue my work for some months but want to stay on ead , is anything wrong. is there any out of status question . because i am not primary person , as a dependent of primary person through primary person i got ead .

    so for dependant person who is having ead can do job any time and if needs can stop doing job as long as i dont want right . there is no wrong right ?

    please tell me attorneys or well known persons.

    I work for a Government Agency as a H1 employee, I have my EAD as well but dont use it. I am sure the attorneys made sure that its ok to hire a H1 as an employee. Now I am doing an AC21.

    I was July 2nd I-485 Filer (for me and my wife), received only my Receipt notice in September. When enquired about my wifes RN in September, USCIS claimed there was no information in the database.

    My lawyer sent a letter to USCIS and they personally responded along with sending the RN for her 2 weeks ago.

    AC 21 allows a job change after 180 days pending of I-485. Will that allow a job change for a similar job position that is employed by a US company but work internationally (i.e. not working in the US)?

    Thank you for the response.
    The salary on Labor is mentioned as $76k. At the time of renewing EAD and AP every year it is at $90k. Since, salary increased after filing GC within the same company.
    With AP portability a lot of advisors say, salary shouldnt be a concern rather job duties are.

    USCIS interpretation is not always in line with the advice we get. I would still try to do thorough research before the huge leap.

    After a long journey on several non immigrant visa's my GC finally got approved. The questions that I would like to throw out for the group to think on is regarding the period for which one has to keep all the H1/H4 approval notices and supporting documents?

    In my case, I have been here for 10 years and have a 15 pound folder that has all the approval notices (I-797) and supporting documents (copies of I-129, transcripts, everything under the sun)

    I would hate to have to carry this for the rest of my life.

    Lawyers - Your legal opinion would provide relief to my aching shoulders :)

    you will need to keep them until you are naturalized. scan them and keep digital copies in a handy location, while you store these originals somewhere in the basement.

    Hello Guys,
    I have been working with my current employer for last 3 years as Software engineer and filed for PERM last October (18th Oct 2007). My six year H1-B limit expires in January 2010.
    Now I'm getting an opportunity to move into Technical Program Management internally (within the same company).
    I have couple of questions based on the above scenario

    1. Is it safe to take the new opportunity since I have to start over my PERM process (given the backlog in Atlanta center) and also given the amount of time left in my H1-B (approx 15 months left)?

    2. If I file a new PERM application now, can I use the experience that I gained in this company as part of the app OR should I use only my previous employer's experience (which was 3-4 years ago and has little relation with what I might do in program management) for the PERM app?

    A frequent question that arises is whether a foreign national living in the United States for a certain number of years can obtain permanent residency based on the years of living in the United States. There is no law or regulation currently in place allowing foreign nationals to automatically obtain permanent residency based on the number of years residing in the United States. There are however, many ways foreign nationals can immigrate and obtain permanent resident status. Two ways to obtain permanent resident status are based on employment and family sponsorship.

    One of the ways foreign nationals can obtain permanent residency is based on employment. The U.S. employer will sponsor the employee to qualify under a certain visa category. Specifically, the foreign national may qualify under one or more of the employment-based “EB” visa preference categories that are divided into four separate categories.

    The four EB visa preference categories are:

    EB-1: Extraordinary Ability, Professors, Researches, or Executives, filed on form I-140
    EB-2: Exceptional Ability in the Sciences, Arts or Business, filed on form I-140
    EB-3: Skilled Worker, Professional, Or Unskilled Worker, filed on form I-140
    EB-4: Immigrant Religious Worker, filed on form I-360


    Another process to obtain lawful permanent residence in the U.S. is through family sponsorship. That is, either a U.S. citizen or permanent resident family member or as a fiancé to a U.S. citizen and subsequent marriage. The process begins by either the U.S. citizen or lawful permanent resident relative filing form I-130 Petition for Alien Relative or form I-129F Petition for Alien Fiance with U.S. Citizenship and Immigration Service (USCIS). Just as in employment-based sponsorship, there are visa preference categories in family-based sponsorship. Family-based “FB” preference categories are divided into four categories.

    FB-1: Unmarried sons and daughters of U.S. Citizens
    FB-2A: Spouses and children of lawful permanent residents of the U.S.
    FB-2B: unmarried sons and daughters of permanent residents of the U.S.
    FB-3: Married sons and daughters of U.S. Citizens.
    FB-4: Brothers and sisters of U.S. Citizens who are at least 21 years old.

    Hi Friends,

    Thanks for answering all my question and I really appreciate all of you for sharing your experience.

    I am new to all these and seeking for Family based GC category 2A applied in May 2005. According to the date in VB for the month of FEB we should get GC as of now but didn't happen.

    I am confused about the "Note" that is written under the Family Based PREFERENCES chart in VB. Could some one make me understand in simple language what the below note says?

    *NOTE: For February, 2A numbers EXEMPT from per-country limit are available to applicants from all countries with priority dates earlier than 01MAR04. 2A numbers SUBJECT to per-country limit are available to applicants chargeable to all countries EXCEPT MEXICO with priority dates beginning 01MAR04 and earlier than 01MAR06. (All 2A numbers provided for MEXICO are exempt from the per-country limit; there are no 2A numbers for MEXICO subject to per-country limit.)

    I dont think so..

    but you never know..

    But my guess is as long as your employer will give you a letter saying they will hire you once your GC is approved, you should be good..as GC is for future employment.
