yes it can happen....

my case: we both filed under premium for our 7th year extension last year and hubby was processed in 5 days, but my H4 took 5 months together with RFE. RFE was stupid enough, they asked to see a copy of already approved H1 7th year.
My advice, wait and see what happens....
Sometimes they pick up H4 a week or so after h1. Good luck.

Need advice from an attorney:

My I-94 expires in december 2010. I have an approved Advance parole till Dec 2011(I485 is pending). Is it required to travel outside the country and get a new I-94 ?

2. Is there a source on the Net that I can refer to that explains this?

I guess what I was trying to illustrate was that I'll be spending less time in PS trying to bring out detail in the eyes which exactly what I did in my original post edit of the first photo. With the set up I have going now you can see the whites of the eyes better along with the color of the eye to the pupil. So less time in PS = more time shooting. ;)

Please note that an I-485 approval invalidates the H-1B visa.

I would travel to the US before Advanced Parole expiry to obtain the GC and return. I am not sure of any exceptions - please post the question in 'Ask a Lawyer' section ASAP.

I second what sbmallik has said. Your records will be at the POE, you cannot come back on H1-B. Come back before AP expires or you might be in trouble.

Consult a lawyer....

I and my my spose applied for AP during April 1st week, both of our AP got rejected because of incorrect fee even though we paid correct fee (305$ each applicant), has any one been in this state, please share your experiences.

I have re-sent the application mentioning Advance parole does not require biometrics so additional 85$ fee is not required.

When I called USCIS they mentioned it might have been rejected in error, please share your experiences.

My job description is "xxx mathematician" on the I-140, but what I'm actually doing is developing and supporting scientific programs. The industry is not IT. If I switch back to IT, could it still be "similar job"?

I am married to GC holder who is becoming USC on April 30. so i am sending my AOS application on May 1. Dont you think i am still in status since my H1b extension petition is pending????

Are you married to a USC? If so, you have nothing to worry about. Do not travel until your GC is approved as AP is not 100% safe for people that overstayed.

I'm in my 3rd year of my first H1-B which will be expired Sep. 2011.

If I transfer my H1-B now to another company, then do I automatically get another 3 years or do I have to file an extension after my H1-B has been transferred?

I have a request / concern / what ever you would say.

Please do not cirtize if you do not like the idea, just ignore and leave the thread.

There are so many people comming to IV for other experts guidance on different things mainly on H1B status, AC21 status, AP, FP, EAD and H4 to EAD, .....

Why don't you create a general guide lines or rules or do's and don't or QA's for each topic, so that each member or visitor who come to IV can atleast go through them before asking or posting quesitons.

You can create a survery for different kinds of questions people / members / visitors might ask or have fore each topic before creating the thread so that we can have a pool of questions and answers for each topic from experts or attorney answered. (you might say we have recordings from attorney Prashanti Reddy, but it would be good if we have some thing which can be referred easily i.e., typed.

These are just some of my thoughts, it can or cannot be implemented. It depeneds on IV admins/Gurus/Experts on this forum.

Gurus, please provide your thoughts.

Please do not ignore this though. It might become a very good guidelines/guide/rulesbook for all, not all questions might be answered but we can atleast try to cover most of the questions through survery and then create the thread for each topic.

Good luck to all. IV is great in doing such a tremendous job.

Before starting the application process for permanent immigration, foreign nationals who enter the United States on non-immigrant visas (NIV) are considered to be here temporarily. The law presumes NIV holders intend to return to their home countries at the end of their stay in the United States. There are many NIV categories — student visas, business visas, visas for tourism, and investor treaty visas to name a few. While NIV applicants must have the intent to return to their home country, there are a few non-immigrant categories that allow a person to have dual intent, that is, to intend to be here temporarily now but eventually to immigrate. Prior to permanently immigrating to the United States, a foreign national will generally enter on a non-immigrant visa (dual intent NIV).

All NIV applicants are required to fill out an application form to the appropriate consular post and submit the DS forms according to the NIV category they are applying. The current forms available are DS-156, 157, 158, 156K, 3032). Currently, twelve consular posts are required to use Form DS-160, a Web-based NIV application form that incorporates all of the current NIV forms into one format via the Web site. When an NIV applicant fills out the form, the applicant has the option of uploading a digital photo. Once the form is submitted online, the NIV applicant will receive a confirmation page. The new DS-160 form is required in twelve posts (including Mexican and Canadian posts, Dublin, Hamilton, Hong Kong, and Tripoli), and the DS-160 form advances the NIV process since it is submitted in advance of the interview.

NIV applicants should make sure to utilize the appropriate DS form according to the consular post requirements currently in place.

Here are few pending immigration bills which have a higher chances of passing in both house and senate. I was looking at some of the bills and noticed when a bill (or a varient )is introduced in both houses simultaneously the chances of that bill passing are higher.

This may be a good idea for us to try pushing some of the EB related measures if we can
into these bills. I know someone may say Hey these are family related bills But remember how they add the immigration, healthcare, veteran measures into budget or appropriation bills.....similarly we can try.
