I (Indian citizen) am on H1B and wife is on H4 (Canadian citizen). If we plan to get some franchisee and invest money from our savings, will she be eligible for E2 visa and work as an owner?

About to apply for 3 year extension of H1B after 6th year( which expires on Dec 1st 2011)
My Questions

If I move to another company as soon as my 3 year H1B extension comes through and they start my GC process again, what do I have to be careful about regarding
1. Is this even possible?
2. Will the H1B keep getting extended after I switch employers.
3. Can I keep my PD?
4. If the new company is in a slightly different field but my job remains similar, does that matter?
5. What happens if after I transfer, my current employer revokes my i-140? Does that matter since my new employer will restart my GC process anyway? (Also, do i get to keep my PD in this case?)

Submit both the I94 at the airport. But maintain copies. Also do not forget to submit the I94 which has the stamp when you entered this country if you have not already done before.

My EB3 AOS was filed in July, 2007.
I have a valid H1 upto July, 2010 and my EAD expires September, 2010.
My wife and daughter have valid H4 upto July, 2010 and their EAD expires September, 2010. Both have used EAD.
APs are expiring in July 2010 for all of us.
My employer has filed for H1 extension.
I have couple of questions regarding my family?s statuses;
1. If my wife and daughter do not want to renew their EADs/APs (or renewal gets delayed beyond September, 2010), what is their legal status in US as they don?t have a valid I-94?
2. As they already used EADs, I think they are not eligible for H4 filing. Can someone confirm?
3. Does anyone have experience of renewing Driving license without EAD or H4 during AOS?

Hello,
Assuming a 40 hr/week position, a person works 2080 hours per year. The Annual Salary for a $46/hr position is $95680/year.
Also, if you only have annual salary for the new position, you could convert to hourly by dividing by 2080.
But I wouldn't even worry about all this. Just send in the annual salary figure (just for your own satisfaction make sure it is more than $46 per hour) and USCIS will figure out the rest.

Actually if you factor in 10-12 holidays and about 20 VC days it will come to roughly 1824 hours a year or roughly 152hr/month avg.

Has anyone requested premium processing of I-140 based on expiry of the sixth year of H1B. My 6th year H1B expires next month and I think I am eligible for premium processing.
You are eligible only if there is *no* other way of extending your H1-B. If your labor certificate is more than 1 year old, then you are not eligible. In that case you can get 1 year extension based on the LC.

NO, you cannot interfile. A Family-based priority date, cannot be used in connection with employment-based. If you are married to a U.S. Citizen, and you already have an approved I-130, you can apply to adjustment of status immediately through the U.S. Citizen. You file AOS now and it may get approved much faster than the employment-based. Once you file the new I-485 through family, you generally should withdraw the employment-based. But wait until you receive a new EAD via the new I-485.

Guys I need your expertise and valuable answers on this:
I have an approved labor and approved I-140. Based on this I've got extension for 3 more years. I have a contract-hire opportunity which requires me to be a consultant for "X" months. I know I can transfer my H1 to another company. But my question is, can I transfer my h1 again to join the client after "X" months.
I am assuming you are already in 7th or beyond year of H1. You can transfer again if your old I140 is not revoked OR you get a new I140 approved while you are a consultant.

Since I already had masters before I joined the company
EB2 labor applied and received approval in Jan 2011
My attorney applied for 140 porting but received priority date as Jan 2011 instead of may 2006. My attorney says immigrations has made a mistake, attorney contacted them and received a reference number basically asking attorney to call back on Jun 1st. I'm concerned on what went wrong and what could be the worst case scenario. How much time are talking about here.
Any information will be greatly appreciated.

This is wrong. If you go out of USA and come back after a gap of 1 year, then only u will get full 6 years. Other wise whatever your status is ( as L1, B1 etc ) that will count into H1 period
As far as I know B1 wont count against H1 time, though L1 will.
L2 and H4 used to count, but they were decoupled at the end of 2006, and time spent in those status dont count against your H1.

1. As to who will receive the receipt number? Will my attornery receive it or will I receive it?
2. Will it be a letter or an email from USCIS?
3. I am the primary applicant. My wife may be offered a permanent position with the company she is working for on a consultant basis. Now the question is - Can she take the offer before her EAD is approved? I mean to say - Can she transfer her H1B processed for the company? Will she have any problem with the AOS application as her paper work (new I797) is changing? We are very confused with this.
